Arizona's New Law Affords Second Chances to Arizonans With Criminal Convictions. ... Section 602-695-2035 to allow the courts to issue an order for a “Certificate of Second Chance” for individuals “whose judgment of guilt is set aside” after a criminal conviction.

Set Aside Conviction

Doug Ducey, Governor of Arizona, recently amended the Arizona Revised Statute to allow people with certain criminal convictions to "set aside" their prior convictions and receive a Certificate of Second Chance. The amendment will take effect in August of 2021. Despite not having a law that erases complete convictions from a person's record, Arizona's law will allow those who have completed their probation or sentence obligations to request to have certain prior convictions set aside and receive a Second Chance Certification so that you can find work, live in a home, and obtain occupational licensing.


Marijuana Case/ Expungement Records

In Arizona, Proposition 207 legalizes recreational marijuana use and possession as well as expunging records related to marijuana arrests, charges, and convictions.

Therefore, as of July 21, 2021, individuals convicted or charged with certain low-level marijuana crimes will be eligible for expungement of their criminal records


Restoration of Civil and/or Gun Rights

Following completion of their sentence, receiving their discharge from prison or probation, and having paid all fines, fees, and restitution, a person may petition the Superior Court where they were convicted to restore their civil rights and **ARS. 602-695-2035(A); 602-695-2035(A) grants a request for restoration of their right to possess firearms.



Request to Reduce Class 6 Undesignated Felony to a Misdemeanor

Several offenses may be charged as undesignated class 6 felonies in Arizona. If an undesignated class 6 felony is reduced to a class 1 misdemeanor after the person is discharged from probation, it becomes a class 1 misdemeanor. Your criminal record will be updated to reflect the change in classification by the court by reducing the undesignated felony to a misdemeanor.
